To register as a Provider for the purposes of creating a profile, connecting with other users, and charging for services, the user must complete a verification process conducted by Beeuphoric to confirm the user’s identity. Beeuphoric reserves the right to undertake all necessary verifications and to deny registration and access to any user who, in the sole discretion of Beeuphoric, does not meet the established requirements for having their profiles listed on our platform.
Providers must read this agreement and indicate acceptance during the registration process. In consideration of his or her use of the service, the user declares that he or she is of legal age to form a binding contract under applicable law and that he or she is over 21 years of age. You agree to abide by this Agreement and everything contained herein, and further agree to (a) Provide true, accurate, current and complete information about yourself as prompted by the registration form available from Beeuphoric. (b) Maintain and update your registration data to keep it true, accurate, current and complete. 3. USERS (Members)
Beeuphoric calls “Members” those persons who access our platform in order to use the functionalities available on the platform to search, connect, communicate with our verified and registered Providers.
If you wish to become a user, you must read this agreement and indicate your acceptance during before using our platform. In consideration of your use of the service, you represent and warrant that you are 21 years of age or older. You agree to abide by this agreement and everything contained herein, and further agree to (a) Provide true, accurate, current and complete information about yourself as prompted by the registration form available from Beeuphoric. (b) Maintain and update your registration data to keep it true, accurate, current and complete. If we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Beeuphoric reserves the right to suspend or terminate your account and refuse any and all current or future use of the service (or any portion thereof) at any time.

The offer and payment of sexual services through the website is strictly prohibited and will result in the cancellation of the account of the providers involved.

4. ACCOUNT OPENING AND REGISTRATION
To access and use the services available on the platform, it is necessary to create an account, choose a password and verify your profile through photos uploaded by users.
Users must verify their profiles in order to confirm and guarantee the veracity of the information and verify that the data corresponds to a real person. For the purpose of profile verification, the user must upload photos where the user’s face is clearly identifiable. The verification of the user will be checked by means of the “Verified User” symbol that appears on the profile.
Our verification process through user uploaded photos is not 100% accurate due to countless factors beyond Beeuphoric’ control. It is possible that sometimes the platform verifies users incorrectly, although we will do our best to correct errors in user verifications, it is the user’s responsibility to use the platform with care and caution.
You must always provide accurate, current and complete information. Beeuphoric has the right to rely on contact and other information provided to us through your account. Your account is non-transferable. You may not share your password with anyone. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify Beeuphoric of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. You may never use another user’s account without Beeuphoric’s prior authorization.
You can control your profile and the way you interact with the service by changing your account settings. By providing Beeuphoric with your email address and phone number you consent to our use of your email address to send you notices about the platform and services. We may also use your email address and phone number to send you notifications and other messages, such as changes to service features, news, and special content. If you do not wish to receive these emails, you may opt-out of receiving them by sending us your withdrawal request via the contact information or by using the “unsubscribe” option in the emails or mobile notifications. Opting out may prevent you from receiving emails about updates, news or special content.
5. ACCOUNT DELETION AND TERMINATION
Users may cancel their accounts at any time and for any reason by following the instructions on the platform or by sending us their request through our contact information. That termination will only result in the deletion of the account and the deletion of all the personal data granted to Beeuphoric.
Beeuphoric reserves the right to terminate your account or your access to it immediately, with or without notice and without liability, if Beeuphoric believes that you have violated any of these terms, registered with false or misleading information or interfered with the use of the platform and the site or services by other users.
Beeuphoric reserves the right to delete any profile that is deemed to be false, misleading or not belonging to a real person who cannot be verified, without prior notice.
6. PLACING A PROFILE
Users declare and agree to the following:
If I upload a profile on Beeuphoric, I certify that I have the right to all the materials I made available to Beeuphoric and said materials do not violate any copyright laws. I also certify that I understand that any vulgar, obscene or X-rated statements or materials will be removed or edited at the Publisher’s discretion.
I certify that I am pictured in and have the right to use the Content provided to Beeuphoric for the purpose of advertising and that I am in full legal possession of the Content. I further certify that all Content is produced in accordance with all applicable provisions of the Child Protection Restoration and Penalties Enhancement Act and are fully compliant with all requirements of 18 U.S.C.§ 2257 and all other applicable Federal, State and Local laws and regulations.
I certify that I and all the individuals pictured or discussed in Content submitted fully understand that the submitted Content is to be used in relation to entertainment advertisement/promotion including publishing of the Content on Internet World Wide Web. I certify that the advertising posted is not to be used for promotion of any illegal activities. I certify that the identification (IDs) provided in order to post photos/visual materials is true legal documents belonging to me, and I take full legal and criminal responsibility for that statement. I understand that in case that the fraudulent ID documents were provided, Beeuphoric upon discovery reserves the right to immediately remove any advertisements and take other steps, including but not limited to such as notifying proper authorities and a permanent ban of the Undersigned and/or any agents from advertising on Beeuphoric and that no credit nor refund will be issued.
7. SERVICE RULES
The use of the platform and the communications established between users within the platform must comply with the following rules and prohibitions:
Beeuphoric reserves the right to terminate the accounts and profiles of users who have violated these terms and conditions, at its sole discretion and without prior notice.
8. FUNCTION “REPORT PROFILE”
Users will have the “Report Profile” function available if they feel that the reported user is violating the rules and terms and conditions described in this document. Beeuphoric will evaluate the reports and make a decision according to the violations committed by the reported user. The “Report Profile” function helps to create a healthy and safe environment for users and should be used with full responsibility and restraint.
Users will also be able to block any user of their choice from their profiles. Blocked users will no longer be able to access that user’s profile or communicate with the user.
9. USER’S CODE OF CONDUCT
You agree, warrant and covenant to use this website in accordance with the following Code of Conduct and You agree and acknowledge that in our sole discretion we may, but are under no obligation to reject or delete any materials posted or uploaded by You which violates any of the following provisions, and/or to terminate Your right to use or access this Website for violating these provisions.
Beeuphoric has a zero-tolerance policy toward human trafficking, prostitution, and any other illegal conduct. We cooperate with law enforcement, pursuant to appropriate process, such as a subpoena, in investigating criminal activity. Users that violate our zero-tolerance policy will be rejected, and the submission of such profiles for publishing or user activity that violates our zero-tolerance policy may result in a referral to law enforcement and immediate account closure. You will not use this site in violation of Beeuphoric’ policies or any federal, state, or local law, and you will report violations to the appropriate authorities.
You will not use Beeuphoric to engage in any form of illegal conduct, harassment or offensive behavior, including but not limited to the posting or uploading of communications or any graphic, video or audio content to the Website which contain libelous, slanderous, abusive or defamatory statements, or racist, obscene or offensive language.
You will not use the website to infringe the privacy rights, property rights, or other civil rights of any person;
You will not post messages or use the Website in any way which (i) violates, plagiarizes or infringes upon the rights of any third party, including but not limited to any copyright or trademark law, privacy or other personal or proprietary rights, or (ii) is fraudulent or otherwise unlawful or violates any law.

11. DISCLAIMER
Beeuphoric only provides users with a platform and virtual space that allows verified users to establish connections in relation to the photos provided by the same users and to communicate through the platform, using the functionalities available on the platform.
Beeuphoric’ services are limited to facilitating communication between registered and verified users making connections within the platform. The communications established by the users in the platform are the sole responsibility of the users themselves. Beeuphoric does not accept any claim or demand from users for commercial or personal relationships arising from communications established by users in Beeuphoric.
Beeuphoric is not responsible for any theft, loss or damage caused to the physical or moral integrity of users during appointments or communications established in the platform. The user is responsible for the meetings, appointments, relationships and communications that users establish through Beeuphoric.
Beeuphoric is not responsible for damages to the physical or moral integrity of persons, such as injuries, death or any other physical and moral damages such as threats, insults and slander that may fall on a person, as a result of the communications established in Beeuphoric. Communications and relationships established between users as a result of any connection within the platform are the sole and exclusive responsibility of the users. We encourage you to be cautious and to take precautions when meeting or communicating with other users.
In case one or more users or any third party initiates any kind of legal, judicial or administrative claim or action against one or more other users, each and every user involved in such claim or action releases Beeuphoric from any liability.
12. Refunds/Credit:
Refunds will be issued for non-published classifieds ONLY, including the classifieds refused on the grounds of obscene/vulgar/illegal content, and will reflect a 10% handling fee. If your profile is not available/offline for over 24 hours, you are entitled to a credit for the downtime only. Should you decide to discontinue your profile with on Beeuphoric due to an outage of over 48 hours, you are entitled to a refund equal to the time your ad is off line ONLY.
There will be no refund nor credit for ads removed due to fraudulent (fake) IDs or DMCA (copyright/ownership infringment) related takedowns. Using a fake ID is illegal, and we hate it, because we don’t want underage people on our web site – so please don’t even try.
13. LICENSE TO USE THE PLATFORM
The ownership rights of the platform and the methods used on the platform belong exclusively to Beeuphoric. Any physical or virtual exposure of the methods used in the platform may result in violations of intellectual property rights.
Beeuphoric gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by Beeuphoric as part of the services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the services as provided by Beeuphoric, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
The user agrees not to use the platform and the services negligently, for fraudulent purposes or in an unlawful manner. Likewise, the user agrees not to partake in any conduct or action that could damage the image, interests or rights of the Beeuphoric platform or third parties.
This service prohibits sending of messages, that: (1) Any kind of messages that are catalogued as SPAM. (2) Are harassing, abusive, defamatory, obscene, in bad faith, unethical or otherwise illegal content (3) distribute trojans, viruses or other malicious computer software (4) Are intending to commit fraud, impersonating other persons, phishing, scams, or related crime (5) distribute intellectual property without ownership or a license to distribute such property (6) Breach, in any way, the terms of service, privacy policy or rules of this web site or the recipients.
Beeuphoric reserves the right to terminate your access immediately, with or without notice, and without liability to you, if Beeuphoric believes that you have violated any of these terms or interfered with the use of the platform or service by others.
14. VIEWING CONTENT
Users declare and agree to the following:
I am at least 21 years of age; The material I am viewing is for my personal use. I believe that as an adult, I have the inalienable right to read and/or view any type of material I choose; At no time will minors be subjected to such material of any kind; I agree that the material contained herein is not obscene or offensive in any way nor will it ever be considered obscene or offensive. I also certify, represent and agree that the material herein is not illegal or considered obscene in my street, town, community, city, state, country or province. If I am not sure, I will not continue.
15. THIRD-PARTY MATERIALS.

24. NON-COMMERCIAL USE
The services and the platform cannot be used in connection with any commercial purpose, except when specifically approved by Beeuphoric. Commercial advertisements, affiliate links and other forms of commercial content without prior notice may result in termination or suspension of services and user account.
25. ELECTRONIC COMMUNICATIONS
Beeuphoric shall not accept any liability for failed, partial or garbled computer transmissions, for any malfunction, failure, poor connection, availability of computer hardware or software, phones, cables, networks, electronic or Internet devices, acts or omissions of any service provider, Internet accessibility or availability or for traffic congestion or unauthorized human acts, including errors or failures.
You agree to defend and indemnify Beeuphoric and any of their directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:
27. CHANGES AND TERMINATION
We may change the platform and these Terms at any time, in our sole discretion and without notice to you. You are responsible for remaining knowledgeable about these Terms. 30. ARBITRATION
The user agrees that any dispute, claim or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation or validity thereof or the use of the platform, shall be resolved by binding arbitration between the user and Beeuphoric, provided that each party retains the right to bring an individual action in a court of competent jurisdiction.
In the event of a dispute arising in connection with the use of the website or the breach of these conditions, the parties agree to submit their dispute to arbitration resolution before a reputable arbitration organization as mutually agreed by the parties and in accordance with applicable commercial arbitration rules.
You agree to initiate a formal dispute proceeding by sending us a communication through our contact information. Beeuphoric may choose to send you a written offer after receiving your initial communication. If we offer and send you a settlement offer and you do not accept the offer, or we are unable to resolve your dispute satisfactorily and you wish to continue with the dispute process, you must initiate the dispute resolution process before an accredited arbitration organization and file a separate Demand for Arbitration. Any award rendered by the arbitration tribunal shall be final and conclusive on the parties.
